Do Kwon, Co-founder of Terraform Labs, Appeals to Montenegro High Court's Decision Once More
Do Kwon, co-founder of Terraform Labs, has made another appeal against the High Court of Montenegro's decision to endorse extradition requests from the United States and South Korea. The appeal came with the suggestion that local courts might be under political pressure concerning Kwon's potential overseas transfer, his lawyer said.
Overturning of Previous High Court Decision
In November, Kwon won an appeal to overturn the High Court's decision that the extradition requests were legally sound. However, on December 29, the same court once again concluded the requests were valid, according to Kwon's lawyer in Montenegro, Goran Rodic.
We appealed again and now we are waiting for a new decision of the Court of Appeal, Rodic stated in an email communication.
Multi-billion Dollar Crypto Enterprise Collapse
Following the collapse of Kwon's multi-billion dollar crypto enterprise, Terraform Labs, in May 2022, authorities in his native country, South Korea, and the U.S. have levied criminal charges against him. These charges include accusations of fraud. Last year, Kwon and an associate were arrested in Montenegro for possession of falsified official documents and sentenced to four months in prison.
While Kwon serves his sentence in Montenegro, the country must approve his extradition and decide the destination.
Grounds for the Appeal
The new appeal was submitted on the grounds that the High Court's decision drastically violates the provisions of the law, the European Convention on Extradition, and the bilateral treaty with America on extradition, Rodic explained.
He also mentioned apparent political pressure on the court, all to the detriment of Do Kwon.
U.S. Counsel's Request
In the meantime, Kwon's legal counsel in the U.S. has requested courts to postpone a securities fraud trial against him so that he can attend in person.
