Legal Representatives Request Postponement of SEC Trial Against Ex-Terra CEO, Do Kwon
Do Kwon, the previous Chief Executive Officer of Terra, is represented by legal counsel who have requested a U.S. court to postpone the Securities and Exchange Commission (SEC) trial against both him and his previous firm. The reasons given for this request include uncertainty surrounding the timeframe for Kwon's extradition from Montenegro.
Circumstances Surrounding the Request
In a document that was initially discovered by Inner City Press, Kwon's legal team stated that the extradition procedure in Montenegro is not progressing at the expected rate. They forecast that their client will likely not be present in the U.S. until February or March at the earliest.
Should the court decide against delaying the trial, Kwon's legal team has requested that the jury be instructed to consider his absence and inability to testify as factors that should not unduly prejudice him. The trial was originally set to begin at the end of January.
Developments in the Extradition Process and Legal Proceedings
There have been delays in Kwon's extradition process, following his legal team's successful appeal against a decision made by a high court in Montenegro. The court had initially decided to extradite him to the U.S. or South Korea. However, the Appeals Court has now ordered a retrial due to concerns over procedural issues.
